Booking terms & activity information

Welcome to EXPLR.SX.

We aim to make every experience — whether a private boat charter, island transfer or another service — smooth, safe and clearly coordinated.

These booking terms apply to reservations made through EXPLR.SX unless different or additional terms are clearly stated before booking.

By making a payment and confirming your booking, you agree to the applicable booking and cancellation terms.

Booking structure & role of EXPLR.SX

EXPLR.SX provides booking, coordination and guest support for private charters, transfers and other experiences delivered by a small network of independent providers.

Each request is reviewed individually based on your date, group size and requirements. We do not operate an instant-booking marketplace or offer unrestricted pre-set inventory.

EXPLR.SX coordinates the booking and guest relationship. Depending on the experience, this may include payments, pre-departure information, passenger details, transport arrangements, dining recommendations or reservations, optional extras and other requests.

The charter, transfer or activity itself is delivered by an independent provider.

The provider remains responsible for the operation of the vessel or activity, including the captain and crew, navigation, safety, staffing, equipment, licensing, insurance and operational decisions.

EXPLR.SX remains available throughout the booking process to assist guests and coordinate with the provider where required.

Availability & confirmation

All bookings are subject to availability and final confirmation.

We only request payment once a suitable option has been identified and availability has been confirmed with the provider.

Your booking is considered confirmed once the required deposit or full payment has been received and confirmation has been issued by EXPLR.SX.

Availability may change until the booking has been confirmed.

Final operational details such as departure time, meeting point, route and itinerary may be confirmed closer to the date of the experience.

Deposit & final payment

Unless otherwise stated at the time of booking, a deposit is required to reserve your charter or experience.

The remaining balance and payment method will be confirmed as part of your booking.

For applicable bookings, the remaining balance is due to EXPLR.SX 7 days before departure. Where supported by the payment method used, you may be asked at the time of booking to authorise EXPLR.SX to charge the remaining balance automatically at that time.

For some bookings, the remaining balance may instead be payable according to the individual payment arrangements confirmed with you, including payment directly to the provider.

For bookings made within 7 days of departure, full payment may be required at the time of confirmation.

Certain premium charters, special dates or individual providers may require different payment schedules or payment conditions. Any different terms will be communicated before payment.

Failure to make a payment when it becomes due may result in cancellation of the booking and does not automatically entitle the guest to a refund of amounts already paid.

Cancellations & refund policy

Unless different cancellation terms are clearly stated before booking, the following standard cancellation policy applies.

Cancellations 7 days or more before departure

Guest cancellations made at least 7 days before the scheduled departure time are eligible for a refund of amounts paid, less any non-refundable payment processing costs incurred.

Cancellations within 7 days of departure

The booking becomes non-refundable 7 days before the scheduled departure time.

Guest cancellations made within 7 days of departure are therefore non-refundable.

This reflects the fact that a private charter reserves a vessel exclusively for your group and the opportunity to replace the booking at short notice may be limited.

Where a remaining balance is still outstanding under the payment arrangement for a particular booking, any amount that remains payable will be governed by the payment and cancellation terms confirmed for that booking.

Different cancellation conditions

Certain premium vessels, yachts, special dates, peak periods or individual providers may have different or stricter cancellation conditions.

Where different conditions apply, they will be communicated before payment and will form part of the terms applicable to that booking.

Changes of date

We understand that travel plans can sometimes change.

Where possible, EXPLR.SX will try to assist with reasonable requests to change the date of a booking.

Changes are subject to vessel or provider availability, operational circumstances and provider approval and cannot be guaranteed.

A request to change the date does not create an entitlement to a refund.

Where a change is possible, additional costs may apply if the replacement date, vessel, service or other booking arrangements differ from the original reservation.

Weather & sea conditions

Weather and sea conditions in the Caribbean can change quickly.

The captain or provider is responsible for determining whether conditions are safe and suitable for the charter or activity to operate.

Routes, departure times, destinations, anchorages and planned stops may be adjusted where reasonably necessary because of weather, sea conditions, safety or operational considerations.

A weather forecast, predicted rain, cloud, wind or a guest’s preference not to travel does not by itself constitute a weather cancellation.

A charter or activity is considered cancelled because of weather or sea conditions only when the captain or provider determines that it cannot safely operate.

If the captain or provider cancels the experience because conditions are unsafe, EXPLR.SX will first try to arrange a suitable alternative date where practical.

If rescheduling is not possible, payments made for the cancelled experience will be refunded, less any non-refundable payment processing costs incurred in processing the original payment.

Payment processing costs & refunds

Payments made by card, PayPal or other electronic payment methods may incur processing costs that are not returned to EXPLR.SX when a payment is refunded.

Where a refund is due under these terms, non-refundable payment processing costs incurred in processing the original payment may therefore be deducted from the refund.

These costs vary depending on factors such as the payment provider, payment method, card type and currency.

EXPLR.SX does not apply a standard cancellation charge in place of these costs where a refund is otherwise due. The deduction relates to non-refundable payment processing costs associated with the transaction.

Refunds may take several business days to appear, depending on the payment provider and the guest’s bank or card issuer.

Travel disruption, illness & personal circumstances

Guest cancellations caused by flight cancellations or delays, missed connections, illness, changes to travel plans or other personal circumstances remain subject to the applicable cancellation policy.

Where circumstances are genuine and a reasonable change of date is possible, EXPLR.SX will try to assist. Rescheduling remains subject to availability and provider approval and cannot be guaranteed.

We strongly recommend appropriate travel insurance covering cancellation, illness, travel disruption and other unexpected events.

Nothing in this section changes the separate provisions applying where the captain or provider cancels an experience because it cannot safely operate.

Cross-border travel, passports & immigration

Some experiences involve international travel between St Martin / Sint Maarten, Anguilla, St Barts or other territories.

Valid original passports are required for international travel.

Depending on the destination and experience, EXPLR.SX may request passport photographs, passport details, nationality, dates of birth or other passenger information before departure so that required passenger manifests, customs or immigration formalities can be prepared.

Guests are responsible for providing requested information promptly and accurately.

Guests are also responsible for ensuring that every member of their group holds the passports, visas, permissions and other documentation required to enter the relevant destination.

Failure to provide required passenger information or to carry the necessary original travel documents may prevent participation and does not automatically create an entitlement to a refund.

Customs, immigration, port, clearance or other local fees may be payable in addition to the charter price unless specifically stated as included.

Where applicable, EXPLR.SX will provide information about these requirements and payment arrangements before departure.

Pre-departure preparation

EXPLR.SX will normally contact guests before their charter or experience to begin final preparations.

Depending on the booking, this may include:

  • collecting passport or passenger information;
  • confirming final guest numbers;
  • confirming accommodation, pickup location or transport requirements;
  • discussing itinerary priorities;
  • discussing lunch preferences or restaurant arrangements;
  • arranging or recommending taxis or other transport;
  • confirming optional extras or upgrades;
  • discussing dietary requirements or special requests;
  • confirming payment arrangements; and
  • preparing information required by the captain or provider.

The timing of this process varies depending on the experience and operational requirements.

Final departure instructions, including the confirmed departure time, meeting point and directions, are normally provided closer to the date once operational details have been reconfirmed.

Guests do not normally need to contact individual providers directly unless specifically asked to do so by EXPLR.SX.

Itineraries, routes & operational changes

Any itinerary discussed before departure should be considered the intended plan rather than a guarantee that every route, destination or stop will be possible.

Private charters and marine activities are subject to weather, sea conditions, customs requirements, local regulations and other operational considerations.

The captain or provider may reasonably change the route, timing, destination, anchorage, swimming or snorkelling locations or other elements of the itinerary where necessary for safety or operational reasons.

The captain has final authority over the navigation and safe operation of the vessel.

A reasonable operational or itinerary change does not by itself constitute cancellation of the booked experience or create an automatic entitlement to a refund.

Guest numbers & booking information

The charter price, vessel selection and arrangements may depend on the number of guests provided at the time of booking.

Please inform EXPLR.SX of any change in guest numbers before departure.

Maximum passenger capacities cannot be exceeded.

An increase in guest numbers may result in additional charter, customs, immigration, port or other charges and may, in some cases, require a different vessel.

EXPLR.SX and the provider cannot guarantee that additional guests can be accommodated after a booking has been confirmed.

Guest lateness & no-shows

Guests are responsible for arriving at the confirmed meeting point at the time instructed by EXPLR.SX.

If a guest or group arrives late, the charter or experience may need to be shortened where the vessel, captain, marina or provider has subsequent operational commitments.

Time lost because of guest lateness cannot normally be added to the end of the charter or refunded.

No-shows are non-refundable.

Where an international charter is affected because guests arrive without the required passports or other travel documentation, this may also be treated as a guest-related inability to participate rather than a provider cancellation.

Health, mobility & participation

Guests should be able to board safely and be reasonably comfortable participating in the marine or outdoor environment associated with their experience.

Please inform EXPLR.SX before booking, or as soon as reasonably possible, of any mobility limitations or other requirements that could affect safe participation so that suitability can be discussed with the provider where appropriate.

Safety equipment is provided by the operator where required.

The captain or provider retains final authority regarding safe participation onboard or during the activity.

Children

Children are welcome on most experiences when accompanied by a responsible adult.

Parents and guardians remain responsible for supervising minors throughout the experience unless otherwise specifically agreed.

Age, size or safety restrictions may apply to certain vessels, equipment or activities.

Please provide accurate information about children in the group where requested.

Alcohol & guest conduct

Alcohol may be available or permitted depending on the experience.

The captain or provider may limit alcohol consumption or refuse continued service where reasonably necessary for safety.

Guests are expected to behave respectfully toward the captain, crew, other participants, property and equipment.

Unsafe, abusive, unlawful or seriously disruptive behaviour may result in participation being refused or the experience being altered or ended without refund.

The captain’s reasonable safety instructions must be followed at all times.

Equipment & optional extras

Equipment such as snorkelling gear, paddleboards, SeaScooters or other items may be included with or added to certain experiences.

Availability varies by vessel and booking.

Guests are responsible for using equipment reasonably and in accordance with any instructions provided.

Loss or damage caused by misuse, negligence or failure to follow instructions may result in additional charges.

Optional extras requested after the original booking may be subject to availability and additional payment.

Independent providers & responsibility

EXPLR.SX provides booking, coordination and guest-support services and works with independent providers to deliver the experiences offered.

The independent provider operating the experience remains responsible for the vessel or activity itself, including navigation, seaworthiness, captain and crew, operational safety, equipment, licensing, insurance and physical delivery of the experience.

EXPLR.SX is not the vessel owner, captain or operator unless expressly stated otherwise.

EXPLR.SX is responsible for the booking and coordination services that it provides directly.

Nothing in these terms excludes or limits liability where such liability cannot lawfully be excluded or limited.

If you experience a problem with your booking or the delivery of an activity, please contact EXPLR.SX. We will assist where reasonably possible and coordinate with the provider as appropriate.

Events outside our reasonable control

EXPLR.SX and independent providers may occasionally be affected by circumstances outside their reasonable control.

These may include severe weather systems, government or port restrictions, border or customs closures, civil emergencies, natural disasters, major infrastructure disruption and other exceptional circumstances.

Where such an event affects a booking, EXPLR.SX will work with the guest and provider to determine the most appropriate available solution.

Any refund, rescheduling or alternative arrangement will depend on the circumstances, amounts recoverable from the provider and any specific terms applicable to the booking.

This section does not replace the weather cancellation provisions above where a captain or provider determines that a charter cannot safely operate because of weather or sea conditions.

Guest responsibilities

Guests are responsible for:

  • providing accurate booking and passenger information;
  • making required payments when due;
  • providing requested passport, passenger or customs information promptly;
  • carrying required original travel documents;
  • checking that they meet applicable immigration and entry requirements;
  • arriving at the confirmed meeting point at the instructed time;
  • following reasonable safety instructions from the captain and crew;
  • treating vessels, equipment and staff respectfully; and
  • informing EXPLR.SX of relevant requirements or changes that could affect the booking.

Your statutory rights

Nothing in these booking terms affects any statutory consumer rights that apply to your booking.

For many bookings, the remaining balance will be due to EXPLR.SX 7 days before departure and may be charged automatically where this has been authorised when booking.

For some charters or experiences, different balance-payment arrangements may apply, including payment directly to the provider.

Bookings made within 7 days of departure may require full payment when confirmed.

Your specific payment arrangements will be communicated as part of your booking.
